These Terms of Service (“Terms”) govern your use of the website and the calling/dispatch service offered by Noon Designs Media LLC, doing business as “Noons Towing” (“we,” “us,” or “our”). By calling us or using our website, you agree to these Terms.
Noon Designs Media LLC is a vehicle assistance and dispatch referral platform. We are not a motor carrier, tow company, or roadside repair company. We do not own tow trucks, operate towing or roadside equipment, or employ drivers. When you contact us, we locate and coordinate an available independent, licensed third-party service provider in your area to perform the service.
All towing and roadside services are performed by independent, licensed third-party providers who are solely responsible for the services they render. The providers are not our employees or agents. We do not control, and are not responsible for, the acts, omissions, workmanship, timing, or conduct of any provider.
Your total price is quoted to you on the call and approved by you before a provider is dispatched. The price you approve is the price you are charged for the requested service — there are no hidden or surprise fees. Your total depends on the service type, distance, and vehicle. Additional or different services requested at the scene, or changes to the situation you described, may require a new quote and your approval.
Availability and arrival times are estimates only and vary by provider, location, traffic, weather, and conditions. We do not guarantee that a provider will be available or will arrive within any particular time.
You agree to pay the approved amount for the services you request. Payments may be processed by third-party payment processors. You are responsible for the accuracy of the information you provide.
To the fullest extent permitted by law, Noon Designs Media LLC is not liable for any loss, damage, injury, or delay arising out of or relating to the performance, non-performance, timing, or conduct of any independent provider, or for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the service is limited to the amount you paid for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to provide accurate information, to have the authority to request service for the vehicle, and to use the service lawfully. You are responsible for the safety of yourself, your passengers, and your vehicle while awaiting a provider.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Any dispute will be subject to the courts located in Wyoming, unless applicable law requires otherwise.
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
